THE CANAL AND DRAINAGE (WEST PAKISTAN AMENDMENT) ORDINANCE, 1965. 1West Pakistan Ordinance No. XXIII of 1965 [8th June, 1965] AN ORDINANCE to amend the Canal and Drainage Act, 1873, in its application to the Province of West Pakistan.
Preamble
AND WHEREAS the Provincial Assembly pf Went Pakistan is not in session and the Governor of West Pakistan is satisfied that circumstances exist which render immediate legislation necessary; NOW, THEREFORE, in exercise of the powers conferred on him by clause (1) of Article 79 of the Constitution, the Governor of West Pakistan is pleased to make and promulgate the following Ordinance:—
Short title extent and commencement
2. In the Canal and Drainage Act, 1873 (hereinafter referred to as the said Act), in the preamble, between the words "all lakes" and the word "and" the comma and 'he words "subsoil water" shall be inserted.

3. In section 3 of the said Act, in sub-section (1), in clause (a), between the word "channels" and the word "and" the comma and the word "tube-wells" shall be inserted.

4. In section 5 of the said Act, between the words and comma "still water", and the word "should", the words and comma "or any sub-soil water" shall be inserted.

5. In section 75 of the said Act, in clause (5), of the following new paragraph shall be added at the end, namely—

"Rules made under clause (4) may be made to have effect retrospectively from any date not earlier than the date on which water has been supplied or the charge has otherwise become leviable under this Act".
