(WEST PAKISTAN AMENDMENT)
ACT, 1967.

further-to amend the Charitable Funds (Regulation of Collections) Act, 1953.

Whereas it is expedient further to amend the Charitable Funds (Regulation of Collections) Act, 1953 (XXXT of 1953), in the manner hereinafter appearing;

Preamble.

It is hereby enacted as follows:—

This Act may be called the Charitable Funds (Regulation of Collections) (West Pakistan Amendment and Extension) Act, 1967.	Short title extent
"2:        In the Charitable' Funds (Regulation of Collections) Act, 1953, hereinafter referred to as the said Act, in section 1, for subsection (2) the following sub-section shall be substituted, namely :-	Amendment of section 11 of Act XXXI of 1953

"(2) It extends to the whole of the Province of West Pakistan, except the Tribal Areas.

3.         In section 2 of the said Act— (a)     for clause (gg), the following clause shall be substituted, namely:— "(Eg) 'Government means the Government of West "Pakistan"; and (b)     in clause (h), for the words "the Commissioner", the word "Government" shall be substituted.

Amendment of section 2 of Act XXXI of 1953

Amendment of section 3 of Act XXXI of 1953

4.         In section 3 of the said Act, for sub-section (2), the following sub-section shall be substituted, namely:—

''(2) Nothing in this Act shall apply to
(a)     any donation made directly to any individual or individuals for the personal benefit of such individual or individuals;
(b)     the income from boxes placed at, and offerings or subscriptions made to or for the purposes of mosques, takias, khankahs, durghas or other shrines, the administration whereof has been taken over and assumed by the Chief Administrator of Auqaf, West Pakistan, under provisions of the West Pakistan Waqf Properties Ordinance, 1961 (XXVIII of 1961).

Amendment of section 10 of Act XXXI of 1953

5.         In section 10 of the said Act, for sub-section (1), the following sub-section shall be substituted, namely:—

"(I)    Government may appoint a person, by name or in virtue of his office, to be the appellate authority for the purposes of this Act."

Substitution of section II of Act XXXI of 1953

6.         For section 11 of the said Act, the following section shall be substituted, namely: —

"11.   Government may at any time revise any order made by the appellate authority or otherwise under this Act and pass such order in accordance with this Act, as it deems proper".

Amendment of section 17 of Act XXXI of 1953	7.         In section 17 of the said Act, for the words "the Commissioner", twice appearing the word "Government, shall be substituted at both the places.
Amendment of section 18 of Act XXXI of 1953	8.         In section 18 of the said Act, for sub-section (1), the following sub-section shall be substituted, namely:-

"(1)   Government may, by notification in the Official Gazette, make rules to carry out the purposes of this Act."
