THE DIR, CHITRAL AND SWAT {ADMINISTRATION) REGULATION, 1969.

A
REGULATION
to provide for certain administrative changes in the tribal Areas comprising the former states of Dir, Chitral and Swat.


            WHEREAS iist necessary to provide for certain administrative changes in the Tribal Areas comprising the former states of Dir, Chitral and Swat;

Preamble

NOW,THEREFORE in pursuance of the Proclamation of the 25th day of March, 1969 read with Provisional Constitution Order and Cabinet Division Notification No. 120/15/69-Min,dated the 8th April, 1969, the Martial Law, Administrator, Zone 'A' exercising the powers of the Governor of West Pakistan and all other powers enabling him in that behalf, with the approval of the President, is pleased to make the following Regulation:—


1.         (1) This Regulation may be called the Dir, Chitral and Swat (Administration) Regulation, 1969.

Short title extent and commencement.

  1. It extends to the Tribal Areas comprising the former States of Dir, Chitral and Swat.
  2. It shall come into force at once.

2.         In this Regulation, unless there is anything repugnant in the subject or context,

Definitions.

(a)     "Ruler" means the person for the time being known as, and exercising the powers and functions of, a Ruler in any of the specified, territories;
(b)     "specified territories" means the Tribal Areas of the formar States of Dir, Chitral and Swat.


3.         Notwithstanding any law, regulations, customs, usage, orders or instruction in force immediately before the commencement of this Regulation, as from such commencement.

Rulers shall cease to exercise administrative Functions etc.

(a)        the Ruler of any of the specified territories shall cease to exercise any powers or perform any functions.

 

         with respect to any matter falling within the legislative competence of the Provincial legislature and relating to the administration of such territories;
(b)     the powers and functions referred to in clause (a) which immediately before the commencement of this Regulation were being exercised and performed by any of the Rulers of the specified territories shall subject to the general supervision and direction of the Provincial Government be exercised and performed by such Officer, person or authority as the provincial Government may appoint or empower in this behalf.


Transfer of service of the servants of the former state.

4. (1)    All persons who, immediately before the commencement of this Regulation, were holding any civil post or office, including a post or office in the forces charged with the maintenance of public order under the administration of any of the specified territories shall as from such commencement be deemed to be persons serving under 1[Provincial Government] of West Pakistan

(2) Notwithstanding anything to the contrary contained in any law, rule, order or instruction for the time being in force or in the conditions of service of persons referred to in clause (1), the Provincial Government may determine the terms and conditions of service to be applicable to them.


Continuance of Taxes.

5.         The proceeds of all taxes, fees, tolls, imposts and other moneys payable under or in accordance with any law in force immediately before the commencement of this Regulation, or any custom or usage having the force of law, towards the revenues of the administration of the specified territories, commonly known as the revenues of the State of Dir, the State of Chitral or the State of Swat, shall be payable toward the revenues of the Province 2[. … …..] and all money so payable towards the public fund or any other fund of any such State shall be payable towards such fund of the 1[Provincial Government] as the Provincial Government may direct.

Constitution of administrative unit.

6.         The Provincial Government may, by notification in the official Gazette, constitute the specified territories in to such administrative unit or units as it may deem fit, and for this purpose may include any such administrative unit any area adjoining the specified territories.

7.         Subject to this Regulation, all laws, including Regulations, Orders, rules, notifications and customs having the force of law, with respect to any matter within the legislative competence of the Provincial Legislature, as were in force in the specified territories or any part thereof, immediately before the commencement of this Regulation, shall, so far as applicable, continue in force, until altered, repealed or amended by the competent authority.

Continuance of Laws.

8.         The Dir (Administration) Regulation, 1967, is hereby repealed.

Repeal of W.P Regulation II of 1967.
