THE FRONTIER EDUCATION FOUNDATION (AMENDMENT) ORDINANCE, 2002.
N.-W.F.P. ORDINANCE NO. XLI OF 2002.
AN
ORDINANCE
to amend the Frontier Education Foundation Act, 1992.
            WHEREAS it is expedient to amend the Frontier Education Foundation Act, 1992 (N.-W.F.P. Act No. III of 1992), in the manner hereinafter appearing;
            AND WHEREAS the Governor of the North-West Frontier Province is satisfied that circumstances exist which render it necessary to take immediate action;
NOW, THEREFORE, in pursuance of the Proclamation of Emergency of the fourteenth day of October, 1999, as amended uptodate, and the Provisional Constitution Order No. 1 of 1999, read with Article 4 of the Provisional Constitution (Amendment) Order No. 9 of 1999, and in exercise of all powers enabling him in that behalf, the Governor of the North-West Frontier Province is pleased to make and promulgate the following Ordinance:
1.         Short title and commencement.— (1) This Ordinance may be called the Frontier
Education Foundation (Amendment) Ordinance, 2002.
            (2)       It shall come into force at once.
2.         Amendment of section 4 of N.-W.F.P. Act No. III of 1992.— In the Frontier
Education Foundation Act, 1992 (N.-W.F.P. Act No. III of 1992), hereinafter referred to as the said Act, in section 4, in sub-section (1),-
(i)         for clause (a), the following clause shall be substituted, namely: -
"(a)      the Chairman, who shall be the Governor of the North-West Frontier Province;";
(ii)        after clause (d), the following new clause shall be inserted, namely:
"(dd)    Secretary to Government, Planning and Development Department;";
(iii)       for clause (f), the following clause shall be substituted, namely:
“(f)      three nominees of the Governor comprising a male and a female from and educational institution belonging to private sector and one person from a non-governmental organization other than an educational institution;”;
(iv)       for clause (g), the following clause shall be substituted, namely:
"(g)      the Managing Director, Bank of Khyber;";
(v)        in clause (k), the word "and" appearing at the end shall be deleted;
(vi)       in clause (1), the full-stop appearing at the end shall be replaced by a semi­colon and thereafter the word "and" shall be added; and
(vii)      after clause (1), as so amended, the following clause shall be added, namely:
"(m)     one eminent educationist to be nominated by the Governor.".
3.         Amendment of section 5 of N.-W.F.P. Act No. III of 1992.— In the said Act,
in section 5,-
(a)        in sub-section (1), the full-stop appearing at the end shall be replaced by a
colon and thereafter the following proviso shall be added, namely:
"Provided that at least one meeting shall be held after every six month."; and
(b)        after sub-section (1), as so amended, the following new sub-section shall be inserted, namely:
"(la) Every meeting of the Board shall be presided over by the Chairman, or in his absence, by the Vice-Chairman.".
4.         Amendment of section 13 of N.-W.F.P. Act No. III of 1992.— In the said Act. in section 13,-
(a)       in sub-section (2),-
(i)         in clause (b), for the word "grants", the word "loan" shall be substituted; and
(ii)        after clause (c), the following new clause shall be inserted, namely:
"(cc)     grant scholarships, stipends, fellowships to students on merit-cum-inaffordability basis, both in public and private educational institutions, including those run by autonomous bodies;";
(b)        after sub-section (2), as so amended, the following new sub-section (3) shall be added, namely:
"(3)      The facility provided under clause (cc) of sub-section (2), shall be distributed equally among male and female students belonging to urban and rural areas. The educational institution concerned shall, in respect of every student to whom the facility under the aforesaid provisions has been extended, allow concession in the tuition fee to the extent of twenty per cent of the total fee being charged by such institution.".
5.         Amendment of section 14 of N.-W.F.P. Act No. III of 1992.— In the said Act, in section 14, for sub-section (1), the following shall be substituted, namely:
"(1) While making loans under this Act, the Board may impose such conditions or execute such agreements as it may consider necessary or expedient for protecting its interest and securing that the loan is put to such use by the borrower for which it was advanced.".
6.         Insertion of new section I5A to N.-W.F.P. Act No. III of 1992.— In the said
Act, after section 15, the following new section shall be inserted, namely:
"15A. Endowment Fund.— In addition to the Fund being maintained under section 15, there shall be established a separate fund to be known as ‘Endowment Fund’ to which shall be credited grants and donations made by Government, including the Federal Government, or any foreign agency or local organization, or by an individual for the specific purpose of grant of scholarships, stipends, fellow-ships, etc. to the students under clause (cc) of sub-section (2) of section 13.".
