THE LAND ACQUISITION (WEST PAKISTAN AMENDMENT) ACT, 1969.

ACT
to amend the Land Acquisition Act, 1894 in its application to the Province of West Pakistan.


            WHEREAS, it is expedient to amend the Land Acquisition Act, 1894 in its application to the Province of West Pakistan;

Preamble

            It is hereby enacted as follows:—


1.         (1) This Act may be called the Land Acquisition (West Pakistan Amendment) Act, 1969.

Short title and extent.

(2) It extends to the whole of the Province of West Pakistan except the Tribal Areas.


2.         In the Land Acquisition Act, 1894, (Act 1 of 1894) in its application to the Province of West Pakistan—

Amendment of section 28 and 34 of Act I of 1894

(a)     in section 28, for the words "interest on such excess at the rate of six per centum", the words "compound interest on such excess at the rate of eight per-centum" shall be substituted, and the following proviso be added at the end:—
"Provided that in all cases where the Court has directed that Collector shall pay interest on such excess at the rate of six per centum from the date on which possession was taken and the payment of compensation or a part thereof has not been made up to the commencement of the Land Acquisition (West Pakistan Amendment) Act, 1969, the rate of compound interest on such excess or balance shall be eight per centum.

(b)     in section 34, for the words "interest thereon at the rate of six per centum", the words compound interest at the rate of eight per centum" shall be substituted; and for the full-stop appearing at the end a colon shall be substituted and the following proviso be added thereafter, namely : —
"Provided that any waiver of the above right by the land owner shall be void and he shall be entitled to tie said interest notwithstanding any agreement to the contrary.
