No. PA/NWFP/Legis/89/6594.—The North-West Frontier Pro­vince Civil Servants (Amendment) Bill, 1989 haying been passed by the Provincial Assembly of the North-West Frontier Province on the 16th May, 1989, and assented to by the Governor of the North-West Frontier Province on the 27th May, 1989 is hereby published as an Act of the Provincial Legislature of North-West Frontier Pro­vince.

further to amend the North- West Frontier Province Civil Servants, Act, 1973.
Preamble.---   WHEREAS it is expedient further to amend the North-West Frontier Province Civil Servants Act, 1973 (N.-W. F. P. Act XVIII of 1973), for the purposes hereinafter appearing;
It is hereby enacted as follows: —


1.         Short title and commencement.----   (1) This Act may be called the North-West Frontier Province Civil Servants (Amendment) Act, 1989.
(2)        It shall come into force at once.
2.         amendment of section 8 of N,-W.F.P. Act XVIII of 1973.---    In the North-West Frontier Province Civil Servants Act, 1973 (N-W F P Act XVIII of 1973), hereinafter referred to as the said Act, in section 8, after sub-section (4), the following new sub­section shall be added, namely:
"(5) The seniority lists prepared under sub-section (1) shall be revised and notified in the official Gazette at least once in a calendar year, preferably in the month of January.".
3.         amendment of section 13 of N,-W.F.P. Act XVIII of 1973.--- In the said Act, for section 13, the following section shall be substituted, namely:
"13.      Retirement from service.— (1) A civil servant  shall retire from service—

  1. on such date after he has completed twenty five years of service qualifying for pension or other retirement benefits as the competent authority may, in the public interest, direct; or
  2. where no direction is given under clause (i), on the completion of the sixtieth years of his age.

(2)        No order under clause (f) of sub-section (1) shall be made in respect of a civil servant unless the competent authority has informed him in writing of the grounds on which it is proposed to make the order and has given an opportunity of showing cause against it.
Explanation.— In this section 'competent authority' mean the appointing authority or a person, higher in rank than the civil servant concerned, duly au­thorised by appointing authority in that behalf.”.
4.         Repeal.---        The North-West Frontier Province Civil Servants (Amendment) Ordinance, 1989 (N.-W F. P. Ordinance No. II of 1989) is hereby repealed.
