AN
ORDINANCE
further to amend the North-West Frontier Province Local Government Ordinance, 1979.


WHEREAS it is expedient further to amend the North-West Frontier Province Local Government Ordinance, 1979 (N.-W. F. P. Ord. IV of 1979), in the manner hereinafter appearing;

Preamble

AND WHEREAS the Governor of the North-West Frontier Province is satisfied that circumstance exist which render it necessary to take immediate action;
NOW, THEREFORE, in pursuance of the Proclamation of the fifth day of July, 1977, read with the Laws (Continuance in Force), order 1977 (C. M. L. A, Order No. 1 of 1977), and in exercise of all powers enabling him in that behalf, the Governor of the North West Frontier Province, is pleased to make and promulgate the following Ordinance.


1.         (1) This Ordinance may be called the North-West Frontier Province Local Government (Amendment) Ordinance, 1980.

Short title and commencement.

(2) It shall came into force at once.


2.         In the North-West Frontier Province Local Government Ordinance, 1979 (N.W.F.P. Ord. IV of 1979), hereinafter referred to as the said Ordinance in section 42—

Amendment of section.42 of N.W.F.P Ord IV of 1979.

(i)      for sub-section (4), the following sub-section shall be substituted, namely;
"(4) No member shall be liable to any proceeding in any Court in respect of anything said and any vote given by him in the meeting of Local Council or a committee thereof so long as such action does not—

  1. under mine the ideology security integrity or solidarity of Pakistan;
  2. seek to create or excite feelings of enmity, * ill-will, or harted between different communities, sects, classes or sections of the citizens of Pakistan:

 

  1. contain any indecent, obscene, scurrilous or ironical expressions or defamatory remarks against or seek to defame any person; and
  2. relate to any matter basically not relevant to or beyond the scope of this Ordinance."; and

(ii)     after sub-section (4), as so substituted, the following new sub-section shall be inserted , namely:—
"(4a) A member who acts in contravention of the provisions of sub-section (4) shall, without prejudice to any other action against him, be disqualified and removed from membership forthwith".

 

3.         In the said Ordinance in section 159, in sub-section (1)

(i)      the fullstop appearing at the end of clause (d) shall be replaced by a semicolon and thereafter the word " or" shall be added; and
(ii)     after clause (d), as so amended, the following new clause shall be added namely:
"(e) has passed a resolution or acts in contravention of the provisions of sub-section (4) of section 42 or propagates any political opinion or indulges in any other political activity.".
