The North West Frontier Province (Amendment of Laws) Act 1997

PA/NWFP/Legis/98/1154.— The North-West Frontier Province (Amendment of Laws) Bill, 1997 having been passed by the Provincial Assembly of the North-West Frontier Province on the 23rd December, 1997 and assented to by the Governor of the North-West Frontier Province on the 8th January, 1998 is hereby published as an Act of the Provincial Legislature of North-West Frontier Province.


THE NORTH-WEST FRONTIER PROVINCE (AMENDMENT OF LAWS) ACT, 1997.
N.-W.F.P. ACT NO. I OF 1998
[First published after having received the assent of the Governor of the North-West Frontier Province in the Gazette of North-West Frontier Province (Extraordinary), dated the 12th January, 1998]
AN
ACT
to amend certain laws.
Preamble.—WHEREAS, it is expedient to amend certain laws for the purposes hereinafter appearing;
It is hereby enacted as follows:—
1.        Short title and commencement— (1) This Act may be called, the North-West Frontier Province (Amendment of Laws) Act, 1997,
(2) It shall come into force at once and shall be deemed to have taken effect on the 1st July, 1997.
2.         Amendment of West Pakistan Act X of 1958.—In the West Pakistan Entertainment Duty Act, 1958 (W.P. Act X of 1958),—

  1. in section 3, in sub-section (1), for the word "hundred", the word "eighty" shall be substituted; and
  2. in section 4, for the word "sixty-five" the word "twenty" shall be substituted.

3.         Amendment of West Pakistan Finance Ordinance VII of 1969.—In the West Pakistan Finance Ordinance, 1969 (W.P. Ord: VII of 1969), section 8 shall be deleted.
4.         Amendment of N.-W.F.P. Act X of 1977.—In the North-West Frontier Province Finance Act, 1977 (N.-W.F.P. Act X of 1977), in section 3, for sub-section (1) the following shall be substituted, namely:
"(1)     For each financial year there shall be levied and collected a tax on cinema payable by the proprietor thereof at the following rates:


(i)    

 in case of cinema classed as a first class cinema;  

Rs. 4000.00 per annum.

(ii)   

in case of a cinema classed as a second class cinema;

Rs. 2000.00 per annum.

(iii)

in case of a cinema classed as a third class cinema:

Rs 500.00 per annum.

Provided that the tax, at the discretion of the proprietor of a cinema, may be deposited for three years at a time, in advance, in which case the rate of tax for each three years shall be Rs. 10,000.00 Rs. 5,000.00 and 1,000.00 respectively.".
5.         Amendment   of N.-W.F.P. Finance Act   III of 1997.—In the North-West Frontier Province Finance Act, 1997 (N.-W.F.P. Act III of 1997), section 8 shall be deleted.
6.    Repeal.—The North-West Frontier Province (Amendment of Laws) Ordinance, 1997 (N.-W.F.P. Ordinance No. XI of 1997) is hereby repealed.
