THE NORTH-WEST FRONTIER PROVINCE AYUB MEDICAL COLLEGE (BOARD OF GOVERNORS) ORDINANCE, 1978. Peshawar-the 27th November, 1978. N.-W.F.P. ORDINANCE No. XIX OF 1978. AN ORDINANCE to provide for the establishment of Board of Governors for the Ayub Medical College in the North-West Frontier Province.
Preamble
AND WHEREAS the Governor of the North-West Frontier Province is satisfied that circumstances exist which render it necessary to take immediate action; NOW, THEREFORE, in pursuance of the Proclamation of the fifth day of July, 1977, read with the Laws (Continuance in Force)Order, 1977, (C.M. L.A. Order No. I of 1977), and in exercise of all powers enabling him in that behalf, the Governor of the North-West Frontier Province is pleased to make and promulgate the following Ordinance:
Short title, extent and commencement.
(2) It shall come into force at once.
(a) "Board" means the Board of Governors established under section 3 of this Ordinance; (b) "Chairman" means the Chairman of the Board; (c) "College" means the Ayub Medical College and includes any hospital attached thereto;(d) "Government" means the Government of the North-West Frontier Province; and (e) "member "means a member of the Board and includes the Chairman.
Incorporation.
3. (1) Government shall, for the efficient administration and management of the affairs of the College, by notification in the official Gazette, establish a Board for the College, consisting of such number of members not exceeding fifteen as may be appointed by it".

The Board shall be a body corporate, having perpetual succession and a common seal, with power subject to the provisions of this Ordinance and the rules and regulations made there under, to acquire and hold property both movable and immovable, and shall by the said name sue and be sued.) (2) Governor of the North-West Frontier Province or his nominee shall be the Chairman of the Board. (3) The members, other than the Chairman, shall hold office during, the pleasure of Government.
4. (1) The Board shall administer and manage the affairs of the College and shall subject to any rules made in this behalf, have all powers necessary for the purpose.
(2) In the exercise of its powers and performance of its function, the Board shall, in respect of policy making, co-ordination and maintenance of educational standards, be guided by such directions as Government may, from time to time, give.
5. (1) The Board shall, for the efficient performance of its functions under this Ordinance, constitute, with such of its members and other persons as it may appoint, the following committees, namely:
(a) The Executive Committee: (b) The Finance and Departmental Grants Committee; (c) The Establishment and Discipline Committee; (d) The Medical Staff Committee; (e) The Hospital Management and Hostels Committee; and (f) The Nursing Committee. (2) Subject to such directions as Government may, from time to time, give in this behalf, a committee constituted under sub-section (1) shall perform such functions as may be prescribed by regulations or otherwise specified by the Board.
6. (1) There shall be a fund to be known as "College Fund" vested in the Board.
(2) AH receipts of the College from any source whatsoever shall constitute the College Fund which shall be applied, subject to any rules made in this behalf, by the Board to meet all expenditure for the administration and management of the affairs of the College and other charges connected with the performance of the functions of the Beard under this Ordinance.
(3) All money at the credit of the Board shall be kept in such custody as may be prescribed by rules.
Maintenance of accounts.
8. (1) The accounts of the Board shall be audited in such manner Audit as may be prescribed by rules.
(2) Copies of the audit report shall be sent to the Board and with the comments of the Board to Government. (3) The Board shall carry out any directive issued by Government for rectification of an audit objection.
Returns and statements.
(2) Government may require the Board to furnish it with — (a) any report return, statement, estimate, statistics or other information regarding any matter under control of the Board or , on any subject with which the Board is concerned ;or (b) any document or copy thereof in the charge or under the control of the Board.
Appointment of first Principal of the College.
11. If any difficulty arises as to the firs., implementation of any provision of this Ordinance, Government may, on the recommendation of the Board, give appropriate directions to remove such difficulty .
Removal of difficulty.
1(11 — A. Delegation of powers. --The Board may delegate any of its powers hinder this Ordinance or the Rules or Regulations made thereunder to the Chairman or any other member of the Board).
Power to make rules.
13. (1) The Board may, subject to the previous approval of Government make regulations to provide for any matter which is not required to be provided for by rules and for which provision is necessary or expedient for efficient conduct of its business or the performance of its functions under this Ordinance.
Power to make regulations.
(2) Where any provision of a regulation is inconsistent with any provision of a rule, the latter shall prevail.
