AN
ORDINANCE
further to amend the North-West Frontier Province, Civil Servants
Act, 1973.


            WHEREAS if is expedient further to amend the North-West Frontier Province Civil Servants Act, 1973 (N.-W. F. P. Act XVIII of 1973), in the manner hereinafter appearing;

Preamble

AND WHEREAS the Governor of the North-West Frontier Province is satisfied that circumstances exist which render it necessary to take immediate action;
NOW, THEREFORE, in pursuance of the Proclamation of the fifth day of July, 1977, read with the Laws (Continuance in Force) Order, 1977 (C. M. L. A. Order No. I of 1977), and in exercise of all powers enabling him in that behalf, the Governor of the North-West Frontier Province is pleased to make and promulgate the following Ordinance:


1.         (1) This Ordinance may be called the North-West Frontier Province Civil Servants (Amendment) Ordinance, 1978.

Short title, extent and commencement.

(2) It shall come into force at once.


2.         In the North-West Frontier Province Civil Servants Act, 1973 (N.-W.F.P. Act XVIII of 1973), after section 12,the following new section shall be inserted, namely:

Insertion of section 12 A to N.W.F.P. Act XVIII of 1973.

"12 A. Certain persons to be liable to removal or reversion.—
          Notwithstanding anything contained in his terms and conditions of service, a civil servant appointed or promoted during the period from first day of January, 1972 to the fifth day of July, 1977, may be removed from service or reverted to his lower post or grade, as the case may be, without notice, by the Governor or a person authorised by him in this behalf, on such date as the Governor or, as the case may be, the person so authorised may, in the public interest, direct."
