AN
ORDINANCE
to amend the North-West Frontier Province Local Government Ordinance, 1979.
WHEREAS it is expedient to amend the North-West Frontier Province Local Government Ordinance, 1979, in the manner hereinafter appearing:
AND WHEREAS the Governor of the North-West Frontier Province is satisfied that circumstances exist which render it necessary to take immediate action;
NOW, THEREFORE, in pursuance of the Proclamation of the fifth day of July, 1977, read with the Laws (Continuance in Force) Order. 1977 (CM.L.A. Order No. 1 of 1977), and in exercise of all powers enabling him in that behalf, the Governor of the North-West Frontier Province is pleased to make and promulgate the following Ordinance:
1. (1) This Ordinance may be called the North-West Frontier Province Local Government (Amendment) Ordinance, 1979.
(2) It shall come into force at once.
2.         In the North-West Frontier Province Local Government Ordinance,1979 (N.-W.F.P. Ord. IV of 1979), hereinafter referred to as the said Ordinance, in section 28, the following explanation shall be added at the end, namely:
"Explanation.—For the purpose of clause (e), a Chairman or member of a Council or Committee established or constituted under the Zakat and Ushr (Organization ) Ordinance,1979 (Ord. XXIX of 1979), shall not be deemed to be in the service of Pakistan, or of a public statutory corporation, a Local Council or other Local Authority.".
3.         In the said Ordinance, after section 28, as so amended, the following new section shall be inserted, namely:
"28-A. Candidate not to contest election on party Basis.—.
(1) No candidate contesting election under the provisions of this Ordinance shall, directly or indirectly,—
(a) give himself out as a candidate or nominee of a political party; or

 

  1. claim or draw or receive any financial or other assistance from any political party; or
  2. bear, display or carry any document, sign, insignia, flag or other thing indicating his association with, or affiliation to, any political party; or
  3. seek votes or support of the people on party basis or on the basis of the manifesto of any political party: or

(e) seek votes or support of the people by attributing party affiliation to any of his opponents.
(2) Whoever—
(a) is found by Government to have contravened the provisions of sub-section (1) shall stand disqualified for being a candidate for elections under this Ordinance for a period of four years; or.
(b) having been elected under this Ordinance, is found by Government to have contravened the provisions of sub-section (1) shall cease forthwith to hold office to which he was elected and shall also stand disqualified for being a candidate for elections under this Ordinance for a period of four years.".

4. In the said Ordinance, in section 34, in sub-section (1), in clause (a), after the figure "28", the words and figure "or section 28A" shall be inserted.
