ACT
further to amend the West Pakistan pure Food Ordinance, 1960.

WHEREAS it s expedient further to amend the West Pakistan Pure Food Preamble. Ordinance, 1960 (W.P. Ord. VII of 1960), in the manner hereinafter appearing;

Preamble

It is hereby enacted as follows:—

1. (1) This Act may be called the West Pakistan pure Food (North-West Frontier Province Amendment) Act, 1976.

Short title, extent and commencement.

(2) It shall come into force at once.

2. In the West Pakistan Pure Food Ordinance, 1960, hereinafter referred to as the said Ordinance, in section 23, in sub-section (1)—

Amendment of section 23 of N.W.F.P. Act XXII of 1960

            (i)     in clause (a), for the words "one year", the words "three years" and for the word "one hundred rupees to two thousand rupees", the words "one thousand rupees to five thousand rupees" shall be substituted;
            (ii)    in clause (b). for the words "three months and not more than two ; years", the words " three years and not more than five years", and for the word "hundred", the word "thousand", shall be substituted; and
            (iii)   in clause (c). for the words "five thousnad", the words "ten thousand" shall be substituted.

3. In the said Ordinance, in section. 27, after sub-section (I), the following Substitution of new sub-section shall be inserted, namely:— "(1a) The Director may of his own accord or on the application in writing of the Inspector taking the sample, or on the application in writing of any other person cause the food or sample of food, retained by the Inspector in pursuance of the provisions contained in clause (b) of sub-section (2) of section 20, to be sent for analysis to the Chemical Examiner to Government, who shall thereupon with all convenient speed analyse the same and report the result of the analysis to the Director in the form specified in the Schedule". Substitution of section 32 of W.P. Ord VII of 1960	4. In the said Ordinance, for section 32, the following section shall be substituted, namely :-

"32. Cognizance of offences.— Offences under this Ordinance shall be cognizable and non-bailable".

Repeal

5. The West Pakistan Pure Food (North-West Frontier Province Amendment) Ordinance, 1976 (N.-.W.F.P. Ordinance No. VIII of 1976), is hereby repealed.
