THE NORTH-WEST FRONTIER PROVINCE UNIVERSITIES (AMENDMENT) ACT, 1985. N.-W. F. P. ACT. NO. VII OF 1985. 5th November, 1985. [First published after having received the assent of the Governor of the North-West Frontier Province in the Gazette of N.-W. F. P. (Extraordinary), dated the 5th Novemeber, 1985].AN ACT further to amend the enactments relating to the Universities in the North-West Frontier Province.
WHEREAS it is expedient further to amend the University of Peshawar Act, 1974 (N.-W. F. P. Act, II of 1974), and the Gomal University Act, 1974 (N.-W. F. P. Act X of 1974), for the purpose here in after appearing;
It is hereby enacted as follows:
1. (1) This Act may be called the North-West Frontier Province Universities (Amendment) Act. 1985.
(2) It shall come into force at once.
2. In the University of Peshawar Act. 1974 (N.-W. F. P. Act 11 of 1974),
(a) in section 10, after sub-section (4), the following sub-section (5) shall be inserted, namely: "(5) The Chancellor shall have the power to with hold assent to such Statutes as are required to be submitted to him by the Senate, if in his opinion, such Statutes are— (a) directly or indirectly against the tenets of Islam or the Ideology of Pakistan; or
In all other cases the Chancellor may assent to such Statutes or refer them back to the Senate for reconsideration; provided that where the Chancellor refers the Statutes back to the Senate for reconsideration, and if upon reconsideration, the Statutes are passed by a majority of three-fourth of the total members of the Senate the Chancellor shall be deemed to have assented to such Statutes."; and
(b) in section 27, in sub-section (2) in the second proviso, between the words "it has been " and the word "approved" the words "or deemed to have been" shall be inserted.
Amendment of N.W.F.P Act X of 1974.
(a) in section 10, after sub-section (4). the following sub-section (5) shall be inserted, namely: "(5) The Chancellor shall have power to withhold assent to such Statute, as are required to be submitted to him by the Senate, if in his opinion, such Statutes are—
In all other cases the Chancellor may assent to such Statutes or refer them back to the Senate for reconsideration; provided that where the Chancellor refers the Statutes back to the Senate for reconsideration, and if upon re-consideration, the Statutes are passed by a majority of three-fourth of the total members of the senate, the Chancellor shall be deemed to have assented to such Statutes; and (b) in section 27, in sub-section (2), in the second provisio, between the word "it has been" and the word "approved", the words "or deemed to have been" shall be inserted.
