THE NORTH-WEST FRONTIER PROVINCE LOCAL GOVERNMENT (AMENDMENT) ORDINANCE, 2001.
N.-W.F.P. ORDINANCE NO. XXV OF 2001.
AN
ORDINANCE

to amend the North-West Frontier Province Local Government Ordinance, 2001.


WHEREAS it is expedient to amend the North-West Frontier Province Local Government Ordinance, 2001 (N.-W.F.P. Ord. No. XIV of 2001), for the purposes hereinafter appearing;
AND WHEREAS the Governor of the North-West Frontier Province is satisfied that circumstances exist which render it necessary to take immediate action;
NOW, THEREFORE, in pursuance of the Proclamation of Emergency of the fourteenth day of October, 1999, as amended up-to-date, and the Provisional Constitution Order No. 1 of 1999, read with Article 4 of the Provisional Constitution (Amendment) Order No. 9 of 1999, and in exercise of all powers enabling him in that behalf, the Governor of the North-West Frontier Province is pleased to make and promulgate the following Ordinance:
1.         Short title and commencement.— (1) This Ordinance m:iy be called the North-West Frontier Province Local Government (Amendment) Ordinance, 2001.
(2)        It shall come into force at once.

  1. Amendment of section 51 of N.-W.F.P. Ord. No. XIV of 2001.— In the Norh-West Frontier Province Local Government Ordinance, 2001 (N.-W.F.P. Ord. No. XIV of 2001), hereinafter referred to as 'the said Ordinance1, in section 51, after the word and comma "shall,11, the words, figures and comma "subject to sections 35 and 36," shall be inserted.
  2. Amendment of section 66 of N.-W.F.P. Ord. No. XIV of 2001.— In the said Ordinance, in section 66, after the word and comma "shall,", occurring for the first time, the words, figure and comma "subject to section 40," shall be inserted.
  3. Amendment of section 107 of N.-W.F.P. Ord. No. XIV of 2001.— In the said Ordinance, in section 107, in sub-section (3), in clause (a), the following shall be inserted
    after the word "Government" occurring at the end, namely:

"for which the Accountant General and each District Accounts Office shall maintain an appropriation register Grant-wise/Department-wise, and shall not pass any bill exceeding the amount credited through authorization".
5.         Amendment of section 111 of N.-W.F.P. Ord. No. XIV of 2001.— In the said Ordinance, in section 111, for sub-section (4), the following sub-section shall be substituted, namely:
"(4) Subject to sub-section (6), the District Government and Tehsil Municipal Administration or Town Municipal Administration may re-appropriate the expenditures relating to the Provincial Account referred to in sub-section (3) of section 107 inter and intra depart men tally, as may be prescribed.".
6.         Amendment of section  119 of N.-W.F.P. Ord. No. XIV of 2001.— In the said Ordinance, in section 119,—

  1. in sub-section (3), for the word and figure "section 119", the words and figure
    "in section 109" shall be substituted;
  2. for sub-section (8), the following sub-section shall be substituted, namely:

"(8) The statements referred to in sub-section (7) shall be approved by simple majority of the Zilla Council, Tehsil Council, Town Council or Union Council, as Ihe case may be, in a special session to be held by the respective Council.".
7.         Amendment of section 180 of N.-W.F.P. Ord. No. XIV of 2001.— In the said Ordinance, in section 180,—

  1. the existing section shall be re-numbered as sub-section (1) of section 180;
  2. in sub-section (1), as so re-numbered, after the figure "123", the words, brackets and figure "and sub-section (3) of this section" shall be inserted; and
  3. after sub-section (1), as so re-numbered, the following new sub-section (2) shall be added, namely:

"(2) Government shall have the power to transfer such amounts from the fund of a dissolved Municipal Corporation, Municipal Committee, Town Committee or District Council of a District, as was available on the thirteenth day of August, 2001, to any local Government in the same or any other District, where such transfer is considered necessary by Government in the public interest.".
