THE NORTH-WEST FRONTIER PROVINCE (AMENDMENT OF CERTAIN LAWS) (SECOND AMENDMENT) ORDINANCE, 2002.
N.-W.F.P. ORDINANCE NO. XLVI OF 2002.AN ORDINANCEfurther to amend certain laws in their application to the North-West Frontier Province.WHEREAS it is expedient further to amend certain laws in their application to the North-West Frontier Province for the purpose hereinafter appearing;AND WHEREAS the Governor of the North-West Frontier Province is satisfied that circumstances exist which render it necessary to take immediate action;NOW, THEREFORE, in pursuance of the Proclamation of Emergency of the fourteenth day of October, 1999, as amended uptodate, and the Provisional Constitution Order No. 1 of 1999, read with Article 4 of the Provisional Constitution (Amendment) Order No. 9 of 1999, and in exercise of all powers enabling him in that behalf, the Governor of the North-West Frontier Province is pleased to make and promulgate the following Ordinance:1. Short title and commencement.— (1) This Ordinance may be called the North-West Frontier Province (Amendment of Certain Laws) (Second Amendment) Ordinance, 2002.(2) It shall come into force at once.2. Amendment of section 9 of Act II of 1999.— In the Stamp Act, 1899 (II of 1999), in its application to the North-West Frontier Province, in section 9,-(i) in clause (c), the full-stop appearing at the end shall be replaced by a semicolon and the word "and"; and(ii) after clause (c), as so amended, the following new clause (d) shall be added, namely:"(d) exempt from payment of duties either in whole or in part in respect of the instrument executed by Al-Shifa Trust, for the transfer of land, donated by Government free of cost measuring 80 kanals, for the construction of an Eye Hospital at Kohat.".3. Amendment of section 78 of Act No. XVI of 1908.— In the Registration Act,1908 (XVI of 1908), in its application to the North-West Frontier Province, in section 78, the full-stop appearing at the end of the second proviso shall be replaced by a colon and thereafter the following new proviso shall be added, namely:"Provided also that the Provincial Government may, by notification in the official Gazette, exempt from payment of registration fee, either in whole or in part, in respect of the instrument executed by Al-Shifa Trust, for the transfer of land, donated by Government free of cost, measuring 80 kanals, for the construction of an Eye Hospital at Kohat.".-----------------------------------------
