No. LEGIS:I(2)76/2623.—The following Ordinance by the Governor of the North-West Frontier Province is hereby published for general information:—
THE NORTH-WEST FRONTIER PROVINCE (AMENDMENT) ORDINANCE, 2002.N.-W.F.P. ORDINANCE NO. XI OF 2002. ANORDINANCE further to amend certain laws in their application to the North-West Frontier Province. WHEREAS it is expedient further to amend certain laws in their application to the North-West Frontier Province in the manner hereinafter appearing; AND WHEREAS the Governor of the North-West Frontier Province is satisfied that circumstances exist which render it necessary to take immediate action; NOW, THEREFORE, in pursuance of the Proclamation of Emergency of the fourteenth day of October, 1999, as amended uptodate, and the Provisional Constitution Order No. I of 1999, read with Article 4 of the Provisional Constitution (Amendment) Order No. 9 of 1999, and in exercise of all powers enabling him in that behalf, the Governor of the North-West Frontier Province is pleased to make and promulgate the following Ordinance: 1. Short title and commencement.—(1) This Ordinance may be called the North-West Frontier Province (Amendment) Ordinance, 2002. (2) It shall come into force at once.2. Amendment of Act II of 1899.— In the Stamp Act, 1899 (II of 1899), in its application to the North-West Frontier Province, in section 9,— (i) in clause (a), in its application to the North-West Frontier Province, the word "and", appearing at the end, shall be deleted; (ii) in clause (b), the full-stop appearing at the end shall be replaced by a comma; and (iii) after clause (b), as so amended, the following new clause shall be inserted, namely: "(c) exempt from payment of duties, either in whole or in part, in respect of any instrument executed between the Pakistan Water and Power Development Authority and any other body corporate or company, which is owned or controlled by the Federal Government or by the Pakistan Water and Power Development Authority, engaged in the generation, transmission or distribution of electric power; provided this exemption shall be admissible for once only.". 3. Amendment of Act XVI of 1908.— the Registration Act, 1908 (XVI of 1908), in its application to the North-West Frontier Province, in section 78, after the existing proviso, the following new proviso shall be inserted, namely: "Provided further that the Provincial Government may, by notification in the Official Gazette, exempt from payment of registration fees, either in whole or in pan, in respect of any instrument executed between the Pakistan Water and Power Development Authority and any other body corporate or company, which is owned or controlled by the Federal Government or the Pakistan Water and Power Development Authority, engaged in the generation, transmission or distribution of electric power, only for once.".--------------------------------------------
