THE POLICE (NORTH-WEST FRONTIER PROVINCE (AMENDMENT) ACT 1985. N.-W. F. P. ACT NO. V OF 1985. 10th September, 1985. [First published after having received the assent of the Governor of the North-West Frontier Province in the Gazette of North-West Frontier Province (Extraordinary), dated the 10th September, 1985].AN Act further to amend the Police Act, 1861.
WHEREAS it is expedient further to amend the Police Act, 1861 (V of 1861), for the purposes hereinafter appearing;
It is hereby enacted as follows :—
1. (1) This Act may be called the Police (North-West Frontier Province Amendment) Act, 1985.
(2) It shall come into force at once.
2. In the Police Act, 1861 (V of 1861), in section 30, in sub-section (3), the full-stop appearing at the end shall be replaced by a colon and thereafter the following proviso shall be added, namely:
"Provided further that he shall refuse to grant a licence in a case in which the Magistrate of the district or the sub-division of a district is satisfied and conveys such satisfaction to him in writing that the grant of the licence is likely to cause a breach of the peace or to be prejudicial to public safety or public interest or maintenance of public order.".
3. The Police (North-West Frontier Province Amendment) Ordinance 1985 (N.-W.F.P., Ord. IX of 1985) is hereby repealed.
