AN
ORDINANCE
Further to amend the Provincial Industrial Development Corporation [West Pakistan) Ordinance, 1962


            WHEREAS it is expedient further to amend the Provincial Industrial Development Corporation (West Pakistan) Ordinance. 1962, consequent upon the setting up of the West Pakistan Small Industrial Corporation and the transfer of certain functions of the West Pakistan Industrial Development Corporation to the West Pakistan Small Industries Corporation;

Preamble

            AND WHEREAS, the Provincial Assembly of West Pakistan is not in session and the Governor of West Pakistan is satisfied that immediate legislation is necessary:
            NOW, THEREFORE, in exercise of the powers vesting in him under clause (1) of Article 79 of the Constitution, the Governor of West Pakistan is pleased to make and, promulgate the following Ordinance:,


1.         (1) This Ordinance may be called the Provincial Industrial Development Corporation (West Pakistan) (Amendment) Ordinance, 1965.

Short title extent and commencement

            (2) It shall come into force on and from such date as Government, may, by notification in the Official Gazette appoint in this behalf.


2.         In the Provincial Industrial Development Corporation (West Pakistan) Ordinance, 1962 hereinafter referred to as the said Ordinance, in section 2, clauses (aa) (cc), (j), (k) and (1) shall be omitted.

Amendment of section 2 of Ordinance No XXXVIII of 1962.

This Ordinance was approved by the West Pakistan Provincial Assembly under Article 79(3) of the Constitution at its meeting held on 2nd December 1965. see Gazette 1965. of West Pakistan. 1965. Extraordinary P. 5443 to 5944.


Amendment of section 15 of Ordinance No XXXVIII of 1962.

3.         In section 15 of the said Ordinance—
(a)     in sub-section (2), for clause (a), the following clause shall substituted, namely —
"(a)    planning promoting, organizing and implementing programmes for the establishment of industries listed in the Schedule and the exploitation of fisheries; and

 (b)    in sub-section (9), the full stop at the end shall be replaced by a colon, and thereafter the following proviso shall be added, namely:—
                        "Provided that the Corporation shall not subscribe to an extent which in the aggregate exceeds such limit as may be notified by Government from time to time"; and
(c)     sub-section (12) shall be omitted.


Omission of section 15-A of Ordinance No XXXVIII of 1962.

4.         Section 15-A of the said Ordinance shall be omitted.

Amendment of section 15-B of Ordinance NO XXXVIII of 1962.

5.         In section 15-B of the said Ordinance-
  1. the words "loan or", wherever occurring, be omitted; and
  2. the proviso shall be omitted.

Omission of section 15-C and 15-D of Ordinance No XXXVIII of 1962.

6.         Section 15-C and 15-D of the said Ordinance shall be omitted.

Amendment of section 15-E of Ordinance No XXXVIII of 1962.

7.         In section 15-E of the said Ordinance, sentence commencing with the words "in the case of loan and ending with the words "foreign currency" shall be omitted.

Omission of section 15-F of 15-G and 15-H of Ordinance No XXXVIII of 1962.

8.         Sections 15-F, 15-G and 15-H of the said Ordinance shall be omitted.
