THE PROVINCIAL MOTOR VEHICLES (NORTH-WEST FRONTIER PROVINCE) (AMENDMENT) ORDINANCE, 2002. N.-W.F.P. ORDINANCE NO. XVII OF 2002. ANORDINANCE further to amend the Provincial Motor Vehicles Ordinance, 1965. WHEREAS it is expedient further to amend the Provincial Motor Vehicles Ordinance, 1965 (W.P. Ord. XIX of 1965), for the purposes hereinafter appearing; AND WHEREAS the Governor of the North-West Frontier Province is satisfied that circumstances exist which render it necessary to take immediate action; NOW, THEREFORE, in pursuance of the Proclamation of Emergency of the fourteenth day of October, 1999, as amended uptodate, and the Provisional Constitution Order No. 1 of 1999, read with Article 4 of the Provisional Constitution (Amendment) Order No. 9 of 1999, and in exercise of all powers enabling him in that behalf, the Governor of the North-West Frontier Province is pleased to make and promulgate the following Ordinance: 1. Short title and commencement.— (1) This Ordinance may be called the Provincial Motor Vehicles (North-West Frontier Province) (Amendment) Ordinance, 2002. (2) It shall come into force at once. 2. Amendment of section 11 of W.P. Ord. XIX of 1965.— In the Provincial Motor Vehicles Ordinance, 1965 (W.P. Ord. XIX of 1965), hereinafter referred to as the said Ordinance, for section 11, the following shall be substituted, namely:"11. Currency of licences.— A licence issued under the foregoing sections shall, subject to the provisions contained in this Ordinance as to the cancellation of licences and the disqualification of holders of licences for holding or obtaining liccncesjbe effective without renewal for a period upto five years, three years or one year, as may be opted by the applicant: Provided that no licence shall be renewed, unless the holder thereof has in his possession of his own copy of the most recent version of the Pakistan Highways Code published by the Federal Government.". 3. Amendment of section 106 of W.P. Ord. XIX of 1965.— In the said Ordinance, in section 106, for sub-section (1), the following shall be substituted, namely: "(1) Whoever drives a motor vehicle or causes or allows a motor vehicle to be used, or lets out a motor vehicle for use in contravention of the provisions of sub-section (1) of section 44, shall be punished with imprisonment for a term which may extend to six months, or with fine which may extend to ten thousand rupees, but shall not be less than five thousand rupees, or with both; provided that a person having been previously convicted of such an offence is again found to be guilty of the offence punishable under this section, then he shall, for every such subsequent offence, be punished with imprisonment for a term which may extend to two years, or with fine which may extend to twenty thousand rupees, but shall not be less then ten thousand rupees, or with both, besides seizing or detaining the vehicle involved in the offence, which shall not be released till final disposal of the case by the court.". 4. Amendment of Twelfth Schedule to W.P. Ord. XIX of 1965.— In the said Ordinance, in the Twelfth Schedule, in Part I,— (a) for the existing entry in column 2 against serial No. 48, the following shall be substituted, namely: "48. Repeating the same violation other than the violation at serial No. 50."; and (b) after the existing entry at serial No. 49, the following new entries shall be added, namely:
