THE PROVINCIALLY ADMINISTERED TRIBAL AREAS (APPLICATION OF ELECTIONS LAW) REGULATION, 2001.

REGULATION


to apply certain laws to the Provincially Administered Tribal Areas of the North-West Frontier Province.
WHEREAS it is expedient to apply certain laws to the Provincially Administered Tribal Areas of the North-West Frontier Province;
AND WHEREAS clause (4) of Article 247 of the Constitution of the Islamic Republic of Pakistan provides that the Governor of a Province, with the prior approval of the President, may, with respect to any matter within the legislative competence of the Provincial Assembly, make regulations for the Provincially Administered Tribal Areas or any part thereof;
NOW, THEREFORE, in pursuance of the Provisional Constitution Order No. 1 of 1999, and the Powers and Functions of the Governor's Order, 1999 (C.E. Order No. 5 of 1999), read with clause (4) of Article 247 of the Constitution of the Islamic Republic of Pakistan, and in exercise of all powers enabling him in that behalf, the Governor of the North-West Frontier Province, with the prior approval of the President, is pleased to make the following Regulation:
1.         Short title, extent and commencement. (1) This Regulation may be called the Provincially Administered Tribal Areas (Application of Elections Law) Regulation, 2001.
(2)        It shall apply to whole of the Provincially Administered Tribal Areas of the North West Frontier Province.
(3)        It shall come into force at once and shall be deemed to have taken effect on the 14th day of December, 2000.

  1. Application of laws.— The North-West Frontier Province Local Government Elections Ordinance, 2000 (N.-W.F.P. Ord. No. VI of 2000), the North-West Frontier Province Local Government Elections (Amendment) Ordinance, 2000 (N.-W.F.P. Ord. VII of 2000), and the North-West Frontier Province Local Government Elections (Second Amendment) Ordinance, 2000 (N.-W.F.P. Ord. IX of 2000), and, so far as may be, all rules, orders, notifications made or issued thereunder on or after the 14th December, 2000, shall apply to the Provincially Administered Tribal Areas.
  2. Certain laws to cease to operate.— (1) If, immediately before the commencement of this Regulation, there was in force in the Provincially Administered Tribal Areas or any part thereof any law, instruments, custom or usage having the force of law corresponding to the provision of the Ordinances mentioned in section 2, then such law, instrument, custom or usage shall, upon such commencement, cease to have effect in the said areas.

(2)        Nothing in sub-section (1) shall effect, -
(a)        the previous operation of such law, instrument custom or usage, or

  1. any obligation or liability acquired or accrued or any penalty, forfeiture or punishment incurred in respect of any offence punishable under such law, instrument, custom or urgage; or
  2. any investigation, legal proceeding or remedy in respect of any such obligation, liability, penalty forfeiture or punishment may be imposed, as if sub-section (1) had not come into force.

4.         Validation.— Anything done, proceeding initiated, order passed, power exercised
and power conferred on, or by any authority under the laws specified in section 2 and rules, orders and notifications made or issued thereunder on or after the 14th December, 2000, shall be deemed to have been validly done, initiated, passed, issued, exercised and conferred.
