A REGULATION to extend the West Pakistan Government Dues Recovery Ordinance, 1962, to the Tribal Areas of West Pakistan.


            WHEREAS clause (2) of Article 223 of the Constitution provides that the Governor of a Province with the approval of President may, with respect to any matter within the legislative competence of the Provincial Legislature, make regulations for a Tribal Area or any part of a Tribal Area situated in the Province,

Preamble

AND WHEREAS it is expedient to extend the West Pakistan Government Dues Recovery Ordinance, 1962 (West Pakistan Ordinance No. XXII of 1962), and to apply for the purposes of the said Ordinance, certain provisions of the revenue recovery Act, 1890 (Act I of 1890), to the Tribal Areas of West Pakistan,
NOW, THEREFORE, in exercise of the powers conferred on him by clause (2) of Article 223 of the Constitution, and having received the approval of the President, the Governor of West Pakistan is pleased to make and promulgate the following Regulation:—


1.         (1) This Regulation may be called the West Pakistan Government Dues Recovery Ordinance, 1962, (Extension to Tribal Areas) Regulation, 1968.

Short title and commencement

(2) It shall come into force at once.


2.         The West Pakistan Government Dues Recovery Ordinance 1962, (West Pakistan Ordinance No. XXII of 1962, and so far as may be, all notifications issued thereunder and in force immediately before the commencement of this Regulation, shall extend to the Tribal Areas.

3.         The Revenue Recovery Act, 1890 (Act I of 1890), except sub-section (4) of section 4 and section 8,9,10 and 11 thereof, shall for the purposes of the West Pakistan Government Dues Recovery Ordinance, 1962 (West Pakistan Ordinance XXII of 1962), apply to the Tribal Areas, and in its application to the Tribal Areas, references therein to a Collector and a District shall respectively be deemed to be references to the Political Agent and the Tribal Area under his administration.
